BOOK REVIEW


Who better to write about the meticulous downfalls of the United States justice system than one who had been directly involved in it for over 5 years? Such a man is Judge Harold J. Rothwax, who wrote his opinion of the justice system in a book entitled Guilty The Collapse of Criminal Justice.


Evidently, the title itself reveals much of Rothwaxs opinion of the justice system. Through a series of cases and personal experiences, Rothwax corroborates his stance on the collapse of criminal justice. An optimal book for Introductory Law students, I enjoyed reading this book. The selection of cases and interesting rhetoric have helped my comprehension of the law, the amendments and several other topics imperative to learning the truth about the justice system. Rothwax effectively explores the different parts of the system in which he is so deeply involved and disputes and agrees with many options with grace and righteousness. Although, his words are of course biased (in my opinion), they provoke thought rather than telling the readers what to think which is often the case with textbooks. Each chapter focuses on different theme or idea of law. Through cases in which Rothwax has been involved in making decisions, he captivates the readers with the interesting outside details that are often left out. Rothwax certainly provides a viewpoint that I havent read or analyzed much before. As a judge, Rothwax makes the final decisions and provides reasonings for why.


"The Plea Bargain" Buy Guilty term paper


Chapter 7 entitled "The Plea Bargain" was definitely my favorite chapter in this book for several reasons. Rothwax is most clear, concise, and logical in this chapter. Rothwaxs analyzation of the criticisms of plea bargaining one by Professor Albert Alschuler was most effective in proving his point. Rothwax rebuts to each one of Alschulers arguments with he own, seemingly more logical one. The cases that Rothwax uses really exemplify the different angles of plea bargaining fully.


Rothwax writes, "Plea bargains, which require the defendant to plead guilty to at least some of the charges, are close to truth-finding process" (pg. 144). His supporting case dealt with a woman who was accused of grand larceny, of stealing from her company by writing checks to herself. There was a sufficient amount of evidence showing the former accusation was accurate such as canceled checks, as well as a prior felony conviction of the same nature. Because of plea bargaining she was actually offered a plea that was less than what she would have gotten had she gone through a regular trial. The question then arises as to why plea bargaining exists, seeing as it often seems to benefit the convict.


Rothwax proceeds in explaining the reasons behind plea bargaining, such as the factors of volume and complexity---how there are more cases than time for trials in the court. By using actual statistics, Rothwax shows the readers how it is virtually impossible to include all the trials in, and therefore it is imperative to prioritize. Plea bargaining helps in this process because it sorts out the trials into three categories misdemeanors, violations, and lesser charges, which are handled in the criminal court.However, because the sentences are generally less severe, some people assume that those who plea bargain get off easier than those who go to trial. Generally, those who choose to plea bargain do get a lesser sentence; however, there certainly are exceptions as Rothwax points out with the case of the woman who shoplifted.


In the end, Rothwax drives the importance of plea bargaining home while also acknowledging its downfalls, and establishing the truth to several myths. Idealistically, there would be enough time to spend equal attention of each trial and the courts would subsequently not have to prioritize. However, according to Rothwax, plea bargaining is necessary until courts have the ability to pay enough attention to each trial.


"Anything But the Truth"


In the first chapter of the book, Rothwax writes a very interesting introduction by using several very personal stories, so that reading the book seems more like a novel than a book about criminal justice, however all the while youre still learning about law. By retelling the heinous murder of Pamela Powers with gruesome details, Rothwax recreates how awful the murder was, and then proceeds to write about the results of the murder. By juxtaposing the two feelings, the readers are impacted by the injustice of the outcome of such a brutal crime. Such a murder would expectedly result in the death penalty or life imprisonment. However, because of the trivial technicalities the attention of the case was reversed from how the murdered should be punished to the technicalities of the actual confession. The police officer supposedly coerced the murderer to reveal things that werent allowed at that point. However, the truth of the matter is regardless of how the murdered was convicted, (even though the officer did not even threaten him or anything), he still nevertheless murdered someone, and that fact should not be overlooked but too often is in the justice system.


The switch of attention from the main point to one of much less significance is an important theme in Rothwaxs book, and he very eloquently expresses his sentiments towards this injustice through his first chapter. Even in the most straightforward, clear cases, Rothwax shows how it is often hard to prove the truth. In a one case where a man murdered his girlfriend, the fact that he was the murderer was not in question but rather whether or not he was actually insane while committing the act as he pled was. Rothwax feels like the court system has gone from being logical and mostly accurate to very convoluted and complex for the wrong reasons. He devotes this first chapter to establishing his fundamental beliefs and ideas of the criminal justice system eloquently and concisely.


"The Rush to Nowhere"


Chapter 5 was another chapter that enjoyed because although it was somewhat redundant, Rothwaxs point became very apparent by the end of the chapter. Essentially this chapter is focused on the right to a speedy trial. Even from the titles on the first page, it becomes evident what he is trying to say, "The rush to nowhere…Speedy trial statutes do not guarantee rapid justice." Above all, the Latin proverb "make haste slowly" is especially effective. After initially reading the proverb, I couldnt make much sense of it; however, the chapter soon changed that. An oxymoron, to make haste slowly is not possible, but it makes one think of the fable of slow and steady wins the race. Speedy trial is granted by the Sixth Amendment for several reasons. To protect the accused from prolonged imprisonment, prevents worry about the trial, and most importantly prevents forgetting the intricate details of the case imperative to making the final verdict. However, one must also pay attention to why the delay took place, by regarding the length and reason for delay. Rothwax acknowledges the beneficial and detrimental affects of speedy trial, it is a good idea because of the aforementioned reasons, however it also contributes to the "congestion that afflicts our courts." However once again, people also abuse the right to a speedy trial by reversing several trials and focusing on the technicalities of a speedy trial, such as in the case of Luperon.


Rothwax makes an especially insightful comment on the irony of the speedy trial on pg. 114 which I enjoyed and agree with, "most defendants and defense attorneys dont want a speedy trial. Delay usually benefits a guilty defendant, and most defendants held for trial and are guilty of some or all of the charges against them." Dan Dalgard, the veterinarian at the Reston monkey house, had perceived the virus he was witnessing in his monkeys to be Simian Fever, one harmless to humans. Hed heard about the effects of Marburg on the human body, not only would he loose his monkeys, but also he was putting himself and his employees at risk. Hed thought Ebola to be no more dangerous than Marburg. Dalgard did not fully realize the agent he was dealing with. He knew nothing of the crashing and bleeding out, or liquefying of the internal organs to the extent that the elder sister Ebola Zaire caused. Dalgard left his employees to carry on working in the environment. When the Army was in the process of nuking the building, wearing their space suits and air filtering devices, Dan walked in with nothing more than a surgeons mask on.


Another character, however, who had had close contact (almost too close at one point) was Lieutenant Colonel Nancy Jaax. She, along with Peter Jharling (the co-discoverer of the new strain of Ebola in the Reston monkey house, which was actually found not to be damaging to humans) and Gene Johnson had worked in Level 4 labs at the Institute on numerous occasions. Nancy, at first, seemed to be enthralled by the idea of holding a deadly agent in the palm of her hand. Only a few layers of rubber and latex separated the hot zone of the lab from the inner safety of her space suit. The data stream, which can transmit for distances up to about 6km, is divided into two streams each at half rate (i.e. 784 kbps). These are independently transmitted over the cables and the data is then recombined at the receiving end. HDSL is an alternative to traditional T1/E1 connections, such as connecting PBXs to telco offices, and is usually cheaper.


HDSL uses less bandwidth (than T1 line) and does not require repeaters. Eliminating repeaters allows for minimal administration and maintenance. Installation, which is quick and easy, is only necessary at the central office and the demarcation point of the customer premises. HDSL technology uses B1Q line coding developed for ISDN.


Since HDSL can live in the same cable binders as other lines, it has been designed to eliminate crosstalk from other DSL interference, as well as reduce electromagnetic coupling. HDSL and HDSL were designed to be compatible with other services such as ADSL or T1, which reduces engineering time and costs. Still, HDSL is lacking equipment interoperability which is an inconvenience for carriers.


HDSL has developed as an industry standard, as defined by Bellcore TA-10 modulation scheme. The high-capacity services offered by HDSL meet customer serving area (CSA) guidelines since it is offered over already existing copper lines.


High Bit Rate DSL is a symmetric technology, which provides the same transmission rate in both directions. HDSL is the most mature DSL, because it has been used to provide T1 transmission over existing twisted pair without the additional provisioning typically required for setting up T1 circuits such as the removal of bridged taps and the installation of repeaters. HDSL requires two cable pairs and goes up to 1,000 feet, while HDSL- requires only one cable pair and supports distances up to 18,000 feet. HDSL does not allow line sharing with analog phones.


HDSL-based hardware can be installed in central office units as a stare alone transport system located near a DS-1 cross-connect frame, in the outside plant or at the customer premises. It also is being integrated into multimedia access/transport platforms based on the synchronous optical network.

Once I have made it to school, providing I have not gotten arrested, I then belong to the


teachers. I do not have to stay there nor do I even have to show up, but they still have authority

grades in the first place, then I would be able to do that and still retain the grade that I think I

His towel, friend who was of African-American ancestry, explains how he got 6 years for armed robbery. It was funny how Derek only went three years for murdering a black man. The towel buddy turns out to be his hero however, as he is the one who sees something in him and talks to his jail "gang" into leaving him alone. When you are in prison, it is best to associate yourself with some kind of group, so you arent an easy target to kill and push around. In this case, the white man was attacked. Even by his Swastika brothers. His enemies, specifically the black minority, were at his back now, without him realizing it. were the ones holding his life in the palm of their hands. The towel -folding friend kept him from getting killed by the black men in prison. They certainly didnt enjoy his swastika tattoos. The black mans one request was to save some for the 'brothaz next time.


When he came out of Prison, things had changed for him, yet on the other hand, his little brother Danny followed in his footsteps and continued the hatred that was against those who killed his father. Eventually the older brother is out of jail and he tries to teach Danny that he is making a mistake. He shows how he has seen the lightness of opposite races, and how even they helped him live to today. Unfortunately the hate has gone too far causing Danny to be murdered by a black boy from his school. This was from a previous conflict in the school bathroom, where Danny blew smoke in front of the black boys face in front of his friends. And the movie has a good psychological point where it displays through the film that the white people discriminate and limit the chances of other races, and the other races get fed up with it. Then we make fun of the minorities and begin to hate and insult, and its hate that causes the hate. He ends up being shot because he was hated. It was the black boy that showed his hatred by shooting the white man that was hated because he hated the black boy in the first place. Now, in the end, there are two of the immediate family dead. Both are due to hate, hate that could have both been stopped.


We are not enemies, but friends. We must not be enemies. Though passion may have strained it must not break our bonds of affection. The mystic chords of memory, stretching from every battlefield and patriot grave to every living heart and hearthstone all over this broad land, will yet swell the chorus of the Union, when again touched, as surely hey will be, by the better angels of our nature. To bring up a contradicting movie, which is a personal favorite of mine, The Boondock Saints is a movie about hatred within the white race. The movie takes place in downtown Boston and holds the site of what has been believed as an organized crime Mob war between the Irish, the Russians, and the Italians. People are being killed left and right and the Russians think they own this and the Italians, they own that, but two men are there to stop that. The Irish brothers, Connor and Murphy, nicknamed the Saints, were granted Gods permission to get rid of the scum in South Boston. They go on action packed killing sprees of bad men, all of whom which are white. This is one of the first movies in which I was able to see the "indifference of good (white) men", which in the beginning of the movie is quoted as the greatest evil by a priest in a South Boston Church. However, its funny how this is what I considered, one of the greatest plots in a film I have ever seen, and yet it isnt a common story like other movies are. Certainly, American History X is a little bit more popular than The Boondock Saints. Its probably because no one cares to rage in the media about a movie that shows killings within the white race.

Since day 1 the white man has not been 100% acceptable with minorities, and since day 1 the laws have changed, but the outcomes have not. With the problems in the city of Milwaukee, these problems permit, and are a result of a society that is not willing to accept change, nor grant opportunity. I believe that many of the publics view on minorities are similar to those of the young man in American History X, where the minorities are social parasites. At least, that is what I believe started this whole mess, why else arent suburban parents allowing their children into their sons and daughters schools? Why do we have to let them, why cant they?


My home city is a subject of arrogance and a happening that has been resulted by an indirect hatred and racial battle. Martin Luther King, Jr. had a dream one day, and as of the 160s a lot has changed but still his dream is not complete. And to go with the other movie, The Boondock Saints, it is apparent that obviously white people can be murderers and live low lives as well. The public fails to realize that, or chooses not to, especially in the city of Milwaukee. Sometimes the indifference of good men, which becomes the greatest evil, can be present in any man of any race. In some of the music we listen to, we are given the words of a man who came from the "Gangstas Paradise." Coolio talks about how he was educated and had money on his mind but wasnt allowed to do so, and he was caught chasing dreams. This very much reminds me of the chapter 0 in Milwaukee because the people who arent selected to go into Chapter 0 almost lose hope as time goes along, because their dreams are not nearly as accomplishable as those who are receiving better education. And who is to say they are subject to have any hope when the white people control their destiny? They are manipulated and told where to go and where not to go as far as education and life in Milwaukee. Minorities are not allowed to engage in being the majority or equivalence of a school system. Districts like Shorewood are not allowing this to happen.


The MPS rate of college students is 15%, why should they be given the chance to dream, if more than likely it is not going to happen? That is just mean, and it slaps them in the face as a result. It becomes a situation that cant have any other solution and how are these souls supposed to make their money? And can we really blame them for hating us? I would be jealous too.
